We serve as trustees, successor trustees, co-trustees or interim trustees for private trusts, charitable trusts, and special needs trusts. Our services in this area include managing and preserving the assets of the trust, distributing income to the beneficiaries of the trust, and handling the tax and financial matters of the trust.
Our Duty of Loyalty
As trustees, we operate in accordance with the terms of the trust document. We have a fiduciary responsibility, meaning we act in the best interests of the trust beneficiaries to manage and preserve those assets.
Real Estate Investment Trusts
The typical trust for which we serve as trustee owns one or more real estate assets that requires frequent oversight and management. We manage the financial accounts for the trust, collect the monthly rents, pay the outstanding bills, oversee the maintenance of the real property, distribute the income to the beneficiaries, prepare the financial statements, and work with the accounting professionals to file the required tax returns.
Passive Investments
We also serve as trustees for trusts that hold other income producing assets or passive investments such as royalties, stocks, bonds, or other privately held securities. In that role, we provide oversight of financial advisors that are hired by the trust to manage passive investment portfolios. This oversight includes regular contact with the financial advisor, review of monthly statements for errors or fraudulent activity, and review of purchases and sales of securities made by the financial advisor to ensure that these transactions are in the best interest of the beneficiaries.
